Markup of H.R. 3101

Tony TrottI attended the Markup of H.R. 3101 (the Twenty-First Century Communications and Video Accessibility Act of 2009) yesterday (June 30th) at the Rayburn House Office Building.  One of the first things I noticed was how many members of the Subcommittee on Communications, Technology, and the Internet were in attendance; I counted 17 out of the 35 members of the Subcommittee present (if I missed any I apologize); both Democrats and Republicans.  Although not everyone was there, it was, by far, the best turnout at any of the Hearings about this bill or its Senate counterpart (S. 3304), that I have attended recently and it was also nice to see a bit of bipartisanship in that both parties were represented and not just too snipe at one another..

In his opening statement, Chairman of the Subcommittee Rick Boucher, said that the bill would “modernize the laws governing access to communication services to individuals with disabilities.” And he said “today’s Markup is designed to expedite the process with the goal of having H.R. 3101 reported by the full Committee and be approved by the House in the latter part of the summer.”

 A very noble goal and one that is achievable.  So even though it might not pass in time for the exact Anniversary of the ADA (as some groups want) it does look like it’s moving into the homestretch.  The Chairman of the full Energy and Commerce Committee, Henry Waxman, said he wanted to get the bill passed on July 26th the Anniversary of the ADA.  Whether it makes it by the Anniversary date or not, the important thing is that it makes it.

 Several members made statements, followed by Rep. Boucher introducing “An Amendment in the Nature of a Substitute” and he called it “the Twenty-First Century Communications and Video Accessibility Act of 2010.”  He explained that the amendment “embodies the modifications that have been agreed upon…” and that it “reflects constructive suggestions received from the disability community…”  It was passed unanimously and so now it will be forwarded favorably to the full Energy and Commerce Committee.
